Constitutional & Writ Petitions

Article 199, fundamental rights, service.

Filing: days · Hearing: weeks–months

The High Court, under Article 199 of the Constitution, will interfere where a public functionary has acted without lawful authority, denied a hearing, or breached a fundamental right. I take writ petitions from Rawalpindi and Islamabad — service matters, regulatory overreach, and the enforcement of constitutional guarantees.

A writ is not a substitute for an appeal. I will tell you, in writing, whether the High Court is the right forum or whether the statutory remedy must be exhausted first. When I file, the petition is short, the annexures complete, and the prayer precise.

  • Writs of mandamus, certiorari and prohibition
  • Habeas corpus and quo warranto
  • Service and employment of civil servants
  • Regulatory and departmental overreach
  • Enforcement of fundamental rights
  • Interim relief with the petition

Bring to the first meeting

The impugned order or omission, the statutory provision relied on by the department, and any representation already made.

Questions

On constitutional & writ petitions.

When is a writ petition the right step?

When there is no adequate alternative remedy, or the act complained of is without jurisdiction or in breach of a fundamental right. If a statute already gives you an appeal that will work, the High Court will usually send you there. I will say so in writing.
